As an RN working in labor and delivery I was amzed that even midwives had no idea what to do with wiccan or pagan families and i had to teach them. I have also baptised fetal demises in catholic tradition. I think pagans, because they also generally know some christian religions would be the best ministers, being able to address more traditions than say a baptist minister for a catholic prisoner. I have been a Wiccan High Priestess for almost 20 years. In no way do I consider my religion to be a second tier faith. This country was founded on freedom of religion and freedom should include the choice thereof; if it is dictated it cannot be considered freedom at all. To deny anyone the comfort of their faith borders on cruel and inhuman punishment. Such conditions would never be considered for other religions and should not be considered for Neopaganism. I remember back in the early 90's reading Christianity today and they sited Wicca/Neopaganism as the fastet growing religion in the US. Some day, I hope Pagans and other so-called "minor" religions will receive the rights and respect they deserve just as much as any other religion. It has become increasingly, and sadly clear to me that America is just not as free and liberal as many would willingly believe. The level of discrimination against alternative religious practices, discrimination against the LGBT community, and the amount of racism still present in the United States today saddens me greatly. I can’t help but wonder how long it can last, seeing as how “discrimination against fellow humans” doesn’t seem to be a sin in the general Christian dogma. Matthew 7:1 “Do not judge, or you too will be judged. For in the same way you judge others, you will be judged and the measure you use it will be used to measured to you.” In the United States Constitution, in the Bill of rights, the very first right in the very first amendment listed: “Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof.”

I did not know there were tiers of religions. I do not remember tiers being stipulated in the Constitution...certainly not in the Bill of Rights. We are a religion in the definition of religion. This is serious and I am afraid for my group. I have a member who chose my trad and group because she wants to raise her expected baby in it. What will happen to that child? This is a slippery slope. The Constitutional framers likely weren't aware of Hindus, Muslims, Shinto, indigenous African religions, Native American faiths, or Wiccans. This doesn't mean that they intended to exclude ANY religion from the First Amendment. Instead, these wise men worded the document so that there would be religious freedom guaranteed to all. Their words were "Congress will not establish religion" nor "prohibit free exercise thereof". This clearly does not exclude Pagans. Nor does the Constitution state "Monotheists only". We've fought this fight already, when establishing Pagan religious organizations, having the right to marry with our ministers officiating, the right to freely assemble, and for civic organizations such as the Boy Scouts to recognize many spiritual paths and religions. I have always wanted to send my support to Pagan inmates and Pagan patients at the hospital, but due to an intense fear of being denied I have not gone to a prison or a hospital to lend my aid to those who need it. With this case, I will now go to the local hospital and try to get my name put on a clergy list so I can be contacted from the request of those who are of my affiliation. For over 200 years, our country has upheld the notion that our forefathers fought so hard to obtain - that we, as a people, would rise above the petty notion of sectarian righteousness and stand together to protect the free expression of religion in these United States. Thomas Jefferson, the principal author of the Declaration of Independence, supported this principle in his autobiography. Recalling the debate over passage of the Virginia Act for Religious Freedom, Jefferson wrote: "Where the preamble declares, this steadfast resolve of our forefathers that coercion is a departure from the plan of the holy author of our religion, an amendment was proposed by inserting 'Jesus Christ,' so that it would read 'A departure from the plan of Jesus Christ, the holy author of our religion;' the insertion was rejected by the great majority, in proof that they meant to comprehend, within the mantle of its protection, the Jew and the Gentile, the Christian and Mohammedan, the Hindoo and Infidel of every denomination." Note those words for posterity - "of Every Denomination." The founding fathers of Virginia, hardly wild-eyed liberals, were students of history and knew the dangers inherent in allowing the government to act as a gatekeeper for religious expression in this country. Freedom of religion is freedom for ALL religions, and not just the first five that come to the narrow mind of a Californian bureaucrat some 200 years after the fact. First tier what?! I am tired of others telling me that I am second-class. I am very tired of being told that I am wrong or unworthy of receiving the government’s approval. If this is the case and I am not protected why then am I paying taxes equal to those that are first class? Why am I spending most of my days working just to make sure I can live on my own two feet, while some of these first tier religious people have never worked a day in their natural life. Most of us pagans have a creed we live by call it what you will, the Law of Three, Harm None, or as the first tiers put it the Golden Rule. Every day I try to live my life in the idea that we as human beings should treat each creature on this earth with the same kind of respect that we would want for ourselves. We are free to live as we please and if we choose to be tree hugging dirt worshipers then any form of government should just back away and say "Sure thing." I rarely ever posts anything on a public forum however, this has me well past mad. I hope to all that is divine that this travesty is halted well before it begins. There are others, but in the interest of space and attention span... I view spiritual/religious exposure, practice, and progress for inmates as essential in rehabilitation. I understand fully that rehabilitation is not necessarily the goal, but see any opportunity in the reduction of repeat offenders (after adopting acceptable social values from ANY spiritual source) as "Cost effective", and find it akin to dereliction for institutions not to accept assistance from the community/society (of which they are an important part). As far as "1st tier"/"2nd tier"... how's this for spin. Having the acceptable belief within my religious group that Neo-paganism is accepting of all "established" religions as paths to spiritual growth... there are no "tiers". Blessed Be. Jason

Excuse me? The Founding Fathers, in their writings, very clearly demonstrated their belief that the First Amendment meant that the government did not favor *any* religion. The First Amendment states, with regard to religion, "Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof;...". There is no "first tier" or "second tier" specification, and any attempt to have a governmental body define such a specification is, on it's face, unconstitutional. It is not up to the government to define what a religion is or is not. CDCR, et al., are trying to play the "my religion is better than yours" card. I support you,Patrick in the fight, and (having not researched the case thoroughly and not understanding all the legal terms and implications) wonder about using the religions of the founding fathers part to indicate they didn't include Wicca - we apply Founding Father thinking to issues that didn't exist then - as with technology. And the court didn't say the Founding Fathers didn't have abortions in their families so must be opposed to them, for instance. The founding of this nation was on the principle of 'religious freedom' - is that no longer an argument? Many of the Founding Fathers were deists, rather than members of an organized religion, and would have wanted freedom to pursue belief in a diety parallel to an organized religion, I would think. Many others, up to a third, were considered Freemasons, a group which claims Christian beliefs but is criticized by many Christian groups for a variety of reasons, among them the belief one can go to heaven by doing good deeds rather than belief in a set of characteristics that define 'God.' So it seems to me a statement on one side in an attempt to define the issue differently could be offset by a bold statement that redefines it. Good luck!

The Amicus brief quote is a false argument. They cannot find a legitimate legal reason to fight against religious acceptance so they are using a semantic argument to say that there are no official acceptance of pagan/wiccan religious beliefs as a "legally and official" accepted religion by state and federal government documentation. So the idea is that they cannot accept the idea of a Religion until it is accepted at a government level as a religion until then the claims of being a religion are just the cry of uneducated masses. Basically saying that all documents submitted cannot be taken at face value as the wording in it accepts the basic tenet that Wiccan/Pagan beliefs are religions. And, as that is not proven in the eyes of the governments, the basic assumption made there is false and the documents cannot be accepted. Bullshit. They are setting themselves up for failure. By trying to claim that there are preferential reasons for accepting a faith, any faith as something to be MORE recognized than another is the same style of arguments that the white supremists used to create laws of segregation against African-Americans. The argument is specious in reasoning and infantile in nature. Consisting of primarily saying I don't believe in you, nani nan boo boo. But we are here we are equal and we will be heard. At this point even if they try to or manage to put in place laws against pagan/wiccan faiths they will have to thereby name them in legal action as something. I am sure their first attempts will be to claim a mass hysteria. :) But in the end they will have to name us as religion thereby defeating their own argument. Any such laws will more easily be defeated because they will be obvious attempts at segregation and prejudicial and differential treatment. Which unless we repeal large sums of equal rights cases and become even more of a military state than we are now, all such laws will have a hard time surviving for long. Especially if we stay diligent. It is not up to anyone in government to decide the status of religion. It is not up to them to decide the status of preferential treatment of religion. In fact the foremost end act of all governments, state and federal, should be to reinforce the nature of "Separation of Church and State". Meaning that no entity especially those connected with the State and Federal Entities should allow or by absence of action allow to have prejudicial, preferential, or discrimination of anyones belief or system of belief by their mandate of agreeing with Separation of Church and State. Any effort to set the limits to what counts as a religion is flawed once it assumes that whatever is accepted in a particular time or place is to be the paradigm for legal status. Christians, Buddhists, Daoists, followers of the Native American Church, Scientologists, Wiccans--all of us accept that we have a distinctive religious orientation, but certainly we have very little in common otherwise. Only one thing ought to matter: those of us accepted as ministers within our respective traditions must be allowed to provide spiritual assistance to those who appeal to us, regardless of their situation. To deny us to function as chaplains, whether in the military or in our penal system,would certainnly appear to be a clear denial of the First Amendment freedom of religion.

I do not know this Gentleman but I would assert that the reason this country is as strong as it has been is because of the Constitution and Bill of Rights. Somewhere in these documents I read about the "state not having an official relegion" and so any ruling to the contrary violates the key element of that statement. ALL of our relegious freedom including those who enjoy "majority status" do so as a result of this key phrase. Many elements in society interpret our liberties literally from the writen documents the republic was founded upon. I would hope they would be as vocal in their unwavering support for relegious freedom and tolerance "for all" as they are when supporting their own faiths views. None is truly free while some are denied their right to worship as they please.

While not strictly speaking an adherent of Brigid, her aspect is included in my belief system, and were I imprisoned I would prefer a Pagan chaplain dedicated to her over any of the other potential options. To see that the courts in California are considering denying the constitutional rights of myself and my brethren, simply because our beliefs do not conform to the monotheistic culture permeating this country, is horrifying. That is not in line with the moral framework this country was founded on, and the very fact that they are considering this denial opens the door to discrimination of a variety most abhorrent. I served in the Army for several years, and as a Pagan, I experienced some of the most vitriolic Christo-centric bigotry imaginable. It was during my time in service that President Bush declared that he didn't believe Pagans had the right to practice their beliefs on a military base. I know many Pagans who are still in the service, and that says nothing of the Pagans who are citizens standing up for their basic rights. I'm a Pagan, a Druid, AND a Unitarian Universalist. I believe it was Thomas Jefferson, one of our greatest Presidents and also a Unitarian, who declared, "The legitimate powers of government extend to such acts as are only injurious to others. But it does me no injury for my neighbor to say there are twenty gods, or no God. It neither picks my pocket nor breaks my leg." It is ridiculous for California, or any state in the US, to claim that one religion is 'more equal' than any other. The Bill of Rights clearly states 'freedom of religion', and as it does not define WHICH religions, nor does it allow for the exclusion of any, it must be taken to include ALL RELIGIONS, including those considered to be 'pagan'. The idea that some religions could seize power or gain such favor in the secular government and declare other religions invalid is completely opposite to the values on which this nation was founded. The arguments of this group are not only flawed but dangerous for all who consider themselves Pagan, as well as for other people in this country. What these people are effectively saying is that there are certain groups of people to whom the Constitution does not apply. Today that is Pagans - will it next be Muslims? What about immigrants? What about homosexuals (oh, wait, they've already invoked that one - are we seeing a trend here?) It seems to me that I have seen this set up before, only it was about seventy years ago and it was in Germany. In addition to the clear danger posed by such arguments, the concept is flawed, as those arguing against Rev. McCollum seem to believe that the Constitution was framed with strict Protestants and Catholics in mind. In fact, many of the founding fathers were Deists, which means that by these people's definition, the Constitution didn't apply to the people who wrote it.

Our Founding Fathers would be angry and dismayed to hear of certain faiths as being classified into hierarchies of 'first tier' and 'second tier', and shocked to hear of the efforts of Christians to establish a permanent hegemony on religious civil rights in America. Actually, the lesser known fact is that most were Masons that supported religious freedom in ALL forms. The first immigrants from Britain to America left because they were denied their religious freedoms within the tyrannical confines of institutionalized Christianity. The writings of many of our Founding Fathers expressed dismay at ANY form of religion, especially Christianity, becoming a tyrannical form of oppression. Thomas Jefferson, for example, wrote "Christianity is the most perverted institution that ever shone on the civilization of man". It is unfair to be anti-Christian, but the fact that a religion that was born in the middle of the oppresive time of Roman rule in the Middle East and fought for such a long time against persecution has ended up turning the tables and being the exact same way to other religions is heinous. Our ancestors were converted from their native ways mainly by fire and sword, and now we must endure more injustice. This situation is shocking, morally, ethically, and Constitutionally. As a member of a so-called 'second tier religion' (although Neo-Paganism is growing dramatically every year in numbers of followers), I am appalled thst my birthright to religious freedom as an American, gifted to me by the Founders of our great country, is being attacked with such viciousness. We MUST all come together as Neo-Pagans, no matter what particular path we follow (I am a follower of Asatru, or Norse Paganism), to fight this horrible injustice and heinous violation of our civil rights. I believe that as Pagan American citizen we should have equal rights of the Christians protection program. Asatru and many other Pagan religions predate Judaism, and gives off more scientific evidence to support our beliefs rather than the fictional tales that are recorded in the Bible. For example my God Odin created man from a piece of drift wood coming from the ocean and that could be seen as symbolism of evolution as where life has been risen from. In the tales of Christianity you get a God who created Adam from clay, this doesn't have any relevance what so ever to evolution as the Germanic belief of Asatru does for evolution, so if anything our religion should be protected under the government and not Christianity. I believe our nation should serve every religion's right to have governmental protection and not just Christianity. More and more I think I should move to Europe because their policies to religious freedoms and protection are more advance and mature than the one of the United States of America. Prove me wrong if you dare! Show me that this country hasn't lost it's freedom and tolerance.

To deny any person the right to a "chaplain" based upon religion is in itself unconstitutional. It impedes on the rights of those who are born on AMerican soil. Christians often speak of the fact that they are persecuted against because of their religion. Yet, they would turn around and treat others in a manner that they wish not to be treated. Even Jesus states to treat others as you would be treated. The constitution states that "Congress shall make NO law respecting an establishment of religion------ no religious Test shall ever be required as a Qualification to any Office or public Trust under the United States." Therefore denying a person a chaplain because of religious beliefs is unconstitutional. Even Ben Franklin questioned religion being involved with government. I think that there are far larger issues to worry about than oppressing the American people further than they already are. Thank you for the fight for our freedom!! After checking my email from a local kindred (Falcon Kindred) regarding this sad and pitiful plight I must admit my heart sank and my soul was overcome with a plethora of other emotions. As a member of the U.S. Army I am disgusted with the disregard of our constitutional rights that I swore to protect and defend against all enemies foreign and domestic. I realize that based on technicalities that our rights have not (yet) been infringed upon to the point that people are persecuted based on their beliefs and principles therein. An all out statement that we are not allowed such practice what so ever would be a tad pre-emptive. However I do understand that certain aspects of practice are denied by certain hurdles caused by the issues we are presented with thus preventing accurate and whole practice. With Asatru for example, some ceremonies require the use or sacrifice of animals. I would prefer to use the term "livestock" as to remind those who oppose such use that they are exactly that. We live in a world where livestock is raised and slaughtered on a mass scale for the food industry leading to a gross waste and misuse of such livestock that the gods, goddesses, and the rest of us should and would be ashamed of. That said, I cannot see how any other use of animals is a problem at all but I know that the subject animal sacrifice is not the only issue at hand, it is about he whole principle of the matter. If we Heathens or Pagans allow our faith to be trampled upon and not defend our rights at all we will be left with none and I don't really like to say this but I think we all would deserve it. It is time to own up to it all or else it all is worth nothing, in the case of Asatru, ages upon ages of honor and all our ancestors have bled and died for will be lost. Nearly was so during the time of humiliations when the only option given was to convert or die. To honor those past heroes that gave all, paid the ultimate price, and/or did what they could do to preserve what they could for future generations is what we need to do. So the least we could do is to stand-up for them, ourselves, and future generations ahead of us. Again, as a soldier who about seven years ago joined the Army as an Infantryman. I swore my oath of enlistment for the first time and it pains me that we must worry about such a thing as this in times we find ourselves in now. Constantly fighting and defending against those ho wish to destroy us for a number of reasons to include our blessing of living in a free and open western society. I am not saying that we must fight as if we were common sub-human terrorists. This is a fight that is quite different, one to be taken to the courts and those who represent us, a peaceful one. For what it is worth, during my first deployment to Iraq in 2003 I was a new soldier and the things I have seen and done with by brothers caused me to contemplate allot of things in life. My religion and where my ancestry lies being a couple of them. Long story short I found myself reading about and doing research on Asatru, after a year or so of studying that I decided to denounce Christianity (which I was raised in, thus not given the choice) and take up Asatru and have felt very complete since. As a soldier we have our "Army Values" and the Nine Noble Virtues just happen to fit very well into what is expected of me as a soldier. Needless to say in such an environment as the military the way I choose to conduct my life in accordance to the Virtues has served me quite well. I now find myself on my third tour in Iraq with plans to take my military career even further and my faith with me. Yet I and fellow service members face another plight, while or faiths are not denied, as they fall under the umbrella term of "Paganism" Asatru in particular is not officially recognized. Wicca has had better fortune but for them it was a long and hard fought battle as it will be for us. I ween for the day that Asatru is officially recognized just as much as any other so that there are representatives in the chaplaincy and any soldier who earns the right to be buried in Arlington may very easily have the Hammer of Thor or the Valknut on their grave marker. As of right now I am not officially a member of any kindred and wish to join one as I have been practicing solo and long for the community and support of those that share my faith. I really hope we all can collectively gain victory over the issues and opponents we face. It is sad that it has come to this, and after all I think it is pretty ridiculous that the government and others seems to think they can regulate religion. When you compare this situation with what is written in the Constitution and signed upon by our founding fathers, any argument from our opponents should be deemed worthless and without substance.

The U.S. Government has already recognised Wicca as a religion, by allowing the pentacle to be placed on the headstones of fallen Wiccans in the Military. Asatru is recognised as a faith by the governments of both Iceland and Sweden. It is imperative, that all minority religions be given the full protection of the governing bodies of each state as well as the federal government, this should include the various polytheistic/Animistic faiths as well, such as Hinduism, Shinto, Wicca and Asatru. There have long been established pagan outreach programs within the prison system also. As a Pagan and a political conservative, I hold that our founding fathers knew very well, the pagan values held by our ancestors, and I hope that they are recognized to be of value within our society today.

As a member of a "second-tier" faith, I will remind our Christian Right fanatic friends that America was set up specifically as a SECULAR STATE. The Founding Fathers were Deists with a sprinkling of Christians among them (Ben Franklin and John Adams being notable examples), BUT when the First Constitutional Congress was asked if there should be a Chaplain "overseeing" the proceedings (recommended by Mr. Franklin), it was roundly voted down, for the perfectly good reason that a war was being fought for freedom from a country with a state religion. You are entitled to feel free if you conform to what certain people feel is proper. Polytheists and spiritualists are not valid? Monotheism is the only protected form of religion? If we are not having difficulties with race relations or sexism then we are struggling with sexuality and religious issues. When is enough enough? You cannot live in a free society if you are stepping on others to scream your view at the top of your lungs. I think its wonderful what you're doing and I want to thank you for fighting so hard for our community. I would like to get involved and help in any way possible. I'm a student at UC Davis (and very close to Sacramento), and am involved in a broad range of campus groups. I can work to get the word out there to people outside of the pagan community, as issues of religious freedom affect us all. I was thinking of using list serves, word of mouth, meetings i attend, and the public space area of campus to get information out there and encourage my friends/community to write letters. I am fairly certain my coven will want to help, especially those who went to this past pantheacon and learned about whats happening with this legal case. I think its important to get people outside the pagan community involved, and just as my father marched in a prop 8 protest on my behalf, i know my friends and family will be there to help us. And i know many groups interested in civil liberties and now that the LGBT resource center on campus will most likely be behind this. I'm wondering if you have any advice or suggestions about how to best go about doing this? or concise information that can be given out that is geared towards non-community members. or template letters for what to put in letters to elected officials.

I worked for the County of Kern for 30 years. It was my belief that discrimination due to religion is a federal offense. If a person has the proper credentials and qualifications for the job, it is illegal to refuse them the position. The person who committed this offense is supposed to be, at the least, suspended, and can be fired, or even barried from any positions within the system. Someone needs to be firmly reminded that there are laws protecting a U.S. citizen's right to practice whatever religion they want. Patrick, Perhaps ten years ago, I was a pen pal of a Pagan inmate in California. He first told me about you and were excited that you were coming to the prison for ritual and class. Afterwards, he told me how much it had meant to him and other Pagans at that prison that you had come as a spiritual leader and led a beautiful ritual and informative class. The last I corresponded with him, he was on parole and had turned his life around. I believe it was in large part due to his spirituality. Who knows how many others you have helped and could continue to help once this injustice is overcome. There are other court cases where Pagans have had their equal religious rights recognized by local, state and federal courts. Title VII of the Civil Rights Act of l964 prohibits religious discrimination in employment and nowhere does it exclude Paganism. Courts have held that it applies to any sincerely held belief. Maybe one other approach to use might be that in our society we are not only not supposed to practice bigotry against other religions, but also other races and other ways of life. Why are tv shows and movies allowed to show us as evil, continuing to add to the streotype? I am astounded and disgusted at the attempt to limit or for a better term eliminate religious freedom here in the United States. America was founded on the idea of freedom to its people. Yet it seems with each passing year and each new law passed, our freedoms are more and more infringed upon. So where will it all end? Where will the line be drawn? The powers that be, on a governmental level, are exerting increasing levels of control in our lives through new legislations and proposed laws aimed at strengthening their private agendas. Freedom was fought for by our founding fathers because they believed freedom would empower us as a nation and move us to great and unimaginable heights. I can't help but believe that those in power today fear that which our nation was founded on. Never was it intended that we, as citizens of the United States, would have our freedoms stripped away from us by the very ones who have been chosen by us as leaders. In fact such actions by the governing body is intended to be halted by its people. This mentality of the founding fathers is what seperates our nation from other more intrusive bodies of government. I read an interesting article that indicated more and more people were returning to the ancient religions of their respective cultures. Could this knowledge be threatening to the structure of society these more mainstream religions have created through acts of mind control and indeed blood shed over the last couple thousand years? This type of legislation attempting to extinguish cultural, spiritual development simply cannot pass. This type of thought process, if not stopped now, poses a very real danger of creating a land with NO freedoms and forces those of many cultures and religions into an underground existence... Once again. Another crusade anyone??? Whether one is a Christian, Asatruar, Buddhist, Wiccan, Muslim, Jewish, or follower of any number of religious organizations--all should take a step back and decide if the government should have this kind of influence in our personal daily affairs. Though I am Asatru, because of my Irish family background and having Brigid as my namesake, I've always held a place for the Irish gods near and dear to my heart. The notion to make some religions "first tier" (protected) and all other religions "second tier" (unprotected) goes against the Religion Clause of the Constitution. What this two-"tier" system would do, in effect, is to create political sanction of religion. In essence a "state religion", much as was the case in many European nations until recent times. "Religion" is a very loaded term as religious belief systems often differ theologically, ontologically, etc. in fundamental and irreducible ways. But the connotative definition of "religion" has come to mean "spiritual belief system". Unless we want a government who establishes a state religion, we must support Rev. Patrick McCollum's quest. His fight is for everyone who wishes to worship honestly and freely.
